    Probe into China’s Antimonopoly Laws and Regulations on the Behavior of Refusal to Deal by Internet Enterprises

    The behavior of refusal to deal by Internet enterprises usually has obvious rationalities, such as saving transaction cost, promoting market entry, improving operating efficiency, and so on. However, the efficiency rationalities, such as preventing free-riding and maintaining product quality, can be hardly found. China’s existing laws and regulations concerning anti-monopoly have such deficiencies as unclear standards, poor operability, and so on. The basic principle of“modest restraining”should be followed in the antitrust regulation on the behavior of refusal to deal by internet enterprises. It is proposed to regard the“market foreclosure effect”as the most important factor to measure the anti-competition effects of the behavior of refusal to deal by Internet enterprises, and add other effects as supplementary investigation factors. Close attention should be paid to the acts of refusal to enter the essential facilities by the Internet enterprises. It is also suggested to introduce the standard of “safe harbor”; when abuse behaviors are being identified, the primary investigation should be applied to the anti-competition effects of the acts rather than the ante-competition intents.

    The modern payment and clearing system takes the central bank NPC system as its core. The prosperity and development of the Internet finance of payment and clearing type has caused large amount of social capital leaving the sight of the central bank, which constitutes great challenges towards the effectiveness of the existing payment and clearing system. In order to control the risks, the central bank has published the Draft of Regulations on E-payment for the purpose of reducing the scale of precipitation funds from the source by restricting the transfer amount of individual accounts and the consumer spending. The third-party payment is the classical pattern of Internet finance of the payment and clearing type, taking this pattern as an example, the legal status of the payment platform has to be clarified, while the legal relationship between the main participants from the perspective of different interests has provided enough room for multiple explaining of the legal ownership of the precipitation funds. On the basis of the cause analysis of the limiting measure, it can be found that fierce interest game is under cover behind the system design. Through the comments on the key provisions listed on the Draft, this paper tries to explore the rational choice of the division between rights and obligations.

    Since the reform and opening up, the socialist ideology with Chinese characteristics has gradually formed and is being constantly enriched and developed, which is playing a significant role in leading the ideology for China’s reform, opening up and socialist modernization construction. At present, the socialist ideology with Chinese characteristics has the economic, political, cultural and social functions, but it is also faced with three major challenges. Along with the economic globalization, the parallel Western ideology does not stop for a moment its penetration. A variety of social thoughts never stop their surging. The ideology of the audiences is usually lost during the networking era to some extent by the massive mixed information. To ensure the epochal character and advancement of the ideology, control the leadership and speaking right of the ideology, and promote the coordinated development of the ideological construction and economic development has become the realization path of the future functional construction of socialist ideology with Chinese features.

    By employing DEA evaluation model, this paper inspects and measures the land use efficiency and its improvement in Poyang Lake Eco-economic Zone in 2011 from the new perspective of low carbon and intensification. The results show that under the guidance of the concept of harmonious development of ecology and economy, the efficiency of low-carbon and intensified land use in Poyang Lake Eco-economic Zone is on the whole rather satisfactory, and most counties (cities and districts) within the zone have paid equal attention to the intensified use and low-carbon use of the land resources. However, the input in regional land area, total highway mileage and social employment has a higher level of redundancy; such issues as regional GDP, the main business income of the high and new technology industry, and insufficient gross output of the qualified construction enterprises are rather prominent; the efficiency of low-carbon and intensified land use in Poyang Lake Eco-economic Zone still has a large room for improvement. Therefore, this paper puts forward the following suggestions: in accordance with the regional function location requirements, the structure optimization of land use should be combined with the adjustment of industrial structure, the scale of land use and the factor input should be reasonably planned, the low-carbon economic development mode should be promoted, and the method of land exploitation and utilization should be pushed to change from extensive mode to low-carbon and intensified mode.

    Since the formulation in 2009, the strategic emerging industries of Jiangxi Province have undergone remarkable development and offered significant contribution to the advancement of provincial industries and economy. Nevertheless, as all the provincial strategic emerging industries in China are formulated within a unified national framework, the phenomenon of industrial isomorphism is serious, which inevitably leads to rather fierce competition. This paper analyzes the competitive edge and the competitive power of the prominent strategic emerging industries in Jiangxi from multiple levels and perspectives, specifies their status in the central region as well as the entire country, and puts forward targeted suggestions and measures for enhancing the competitiveness of Jiangxi strategic emerging industries.

    As the important carrier and main body of modern agricultural industrial system, the ecological transformation of the growth mode of the leading agricultural enterprises is of great significance for the development of China’s modern agriculture and ecological agriculture. The key to the successful implementation of ecological development of the leading agricultural enterprises is to have the corresponding ecological growth ability. By constructing the ecological growth capability structure model of the leading agricultural enterprises, and taking the leading agricultural enterprises of Poyang Lake Eco-economic Region as the sample, this paper conducts an empirical research. The result shows that the ecological growth capability of the leading agricultural enterprises is a multi-dimensional capability system, which can be divided into three dimensions, such as the ecological strategic capability, the ecological network capability and the ecological innovation capability. These can be further divided into seven sub-dimensions, such as the ecological strategic insight capability, ecological strategic matching capability, ecological strategic implementation capability, ecological network relationship capability, ecological network resources integrating capability, ecological technology innovation capability and ecological innovation support ability. There are closer correlations between these dimensions.

    Out of the purpose of molding image projects of modern agriculture, some local governments are actively promoting large scale transfer of arable land to enterprises. However, the agricultural enterprises have two inherent weaknesses: the difficulty in supervision and stimulation and the weak quality of agriculture, which render the agricultural enterprises difficult to form large scale agricultural production capability. There are many malpractices in large scale transfer of arable land to enterprises; therefore, transfer of arable land should be mainly turned to farmers with scale operation rather than the industrial and commercial enterprises. The experiences at home and abroad and many case studies have also proved it. At present, it is necessary to change this idea of transferring arable land to enterprises, the supervision of transferring arable land to industrial and commercial enterprises should be strengthened and the risks should be prevented, and the policy favoring the large scale transfer of arable land to enterprises should be abandoned.

    The number of the only-child-lost families in China has reached several millions and is still on the rise. Surveys show that death caused by illness or accidents is the major cause of the only-child-lost families, and this cause usually leads them to economic difficulties. Economic support, therefore, has become the basic content of the assistance system for these families, having the three natures of social assistance, social special care and social insurance. However, there are a number of issues existing in the present economic support policy for the only-child-lost families, such as lower standard of the national assistance, bigger gap between regions, imperfect dynamic adjustment mechanism, incomplete policy service, single type or channel for assistance, and so on. It is suggested to perfect China’s present economic support policy for the only-child-lost families through such measures as perfecting the dynamic adjustment mechanism, improving the policy service, diversifying methods of assistance, giving full play to the role of social forces, etc..

    The securitization of the embedded value of insurance policy refers to the process of issuing bonds in the capital markets by life insurance companies with their acquisition cost from life insurance, the future business operation profits and the surplus assets from closed block of business as the guarantee, so as to meet the various financing needs of the life insurance companies by means of one-time realization in advance of the embedded value of insurance policy. This paper summarizes the market development and classification for the embedded value securitization, elaborates on the operational mechanisms of the AC, VIFB and CBB securitization, and finally offers the pricing method to calculate the embedded value of life insurance policy with examples.

    Tourism industry has found its way into the national strategic system and is developing towards the strategic pillar industry of national economy and the modern service industry that can better satisfy the masses. Travel agencies are faced with the transformation from providing consumer service into contracted production service, and the service innovation is one of the key drivers of the transformation. Taking the widely applied 4D Service Innovation Model as the theoretical framework, this paper conducts an empirical analysis of the types, features and problems in the service innovation of travel agencies through deep-interviews and participative observations with professionals who are involved in the organization of MICE. The results indicate that the invalid operations, backward technological means and insufficient input resulted from the reform of service transmission system, i.e., the organizational structure, are the key factors restricting the service innovation of travel agencies. Further analysis of the main points of implementing draws such a conclusion that the integration of the reforms of structure, personnel and technology at the height of strategy is the essence of keeping the innovative competitiveness for travel agencies.

    Through an empirical analysis of the questionnaire survey data and by constructing a multiple regression model of labor relations in the private sector, this paper finds out that the labor relations in private enterprises are influenced and restricted by such factors as relationships between colleagues, labor union organization, sick leave pay, injury leave pay, deduction of wages, working conditions and so on. At this stage, to achieve harmonious, stable and healthy operation of the labor relations in private enterprises, we should make improvements from the following aspects: the work environment, the physical environment, the interpersonal communication environment and the organizational environment.

    Resource over-exploitation and single industrial structure are the prominent problems haunting the resource-based cities in China, so it is necessary to change this situation through development of continuous industries. Taking China’s 32 typical resource-based cities as research object, this paper conducts an empirical analysis of the panel data by using GMM estimation with the software of EViews 6.0. The result indicates that the mode of industry substitution is the best choice for the sustainable development of the resource-based cities. In addition, it puts forward corresponding policy suggestions from the four aspects of commerce, finance, waste utilization and environmental management, that is, developing commerce actively in order to promote the prosperity of the tertiary industry, attracting financial investment in order to improve financial system construction, improving the level of waste recycling in order to promote the secondary resources construction, and strengthening the efforts in environmental governance in order to guarantee the harmonious economic and social development.

    Through a DEA static analysis and Malmquist index dynamic analysis, this article conducts a dynamic evaluation on and comparison between the green efficiency of 36 cities at prefecture-level or above in the Central Delta and the Yangtze River Delta during 2000-2012. According to the leading surface analysis of the model, the green efficiency contribution ratio analysis, the analysis of green efficiency score and its variance coefficient, a conclusion is drawn that the green efficiency of the Central Delta Urban Agglomeration is significantly below that of the Yangtze River Delta, and the difference tends to be enlarged; the Central Delta Urban Agglomeration is at the lower level of the balanced development stage, for the green growth pole has not formed yet; while the Yangtze River Delta is at the higher level of unbalanced development stage, the green growth pole has been formed and obvious diffusing effect has been generated; the green efficiency of provincial capitals in both the Central Delta and the Yangtze River Delta is comparatively lower, the key is green transformation.
