食品安全治理改革的障碍与路径探析

摘要: 在食品安全治理领域,单纯的市场机制抑或政府机制无法有效解决食品安全问题,需要完善政府、市场和第三方组织共同参与的食品安全治理新机制。应通过进一步健全相关法律体系,以整顿干部队伍“四风”的勇气和胆识,加强食品安全规制和对规制者的规制,建立对明知故犯的问题食品生产经营者终身禁商的严惩机制,并以此为基础建立企业自律机制,同时应进一步规范和加强新闻媒体等第三方组织参与食品安全治理行为,防止对食品企业正当利益的肆意侵犯,从而有效提升我国食品安全治理水平。

Abstract: Neither market mechanism nor government mechanism alone can effectively solve the problem of food safety in the field of food safety governance. The effective solution is to improve the new food safety governance mechanism participated jointly by government, market and the third party organization. This paper holds the idea that we should further improve the related legal system, strengthen the regulation of food safety and the control of the regulators with the courage and insight of rectifying the“four winds”among the leading cadres, establish a severe punishment mechanism of lifelong ban from business towards those who produce and operate the unqualified food knowingly, on this basis a business self-discipline mechanism should be established. At the same time, we should further standardize and strengthen the food safety governance behaviors involving news media and other third party organizations, guard against the willful violation of the legal benefit of the food enterprises, so as to effectively promote food safety management level in China.
