网约车市场规制重塑研究:基于对抗资本无序扩张视角

Research on the Reshaping of Regulations for the Online Car-Hailing Market: From the Perspective of Opposing Capital's Disorderly Expansion

摘要: 凭借数据、技术、资本优势,以网约车市场为代表的平台领域呈现市场集中度越来越高、市场资源加速向头部平台集中等趋势,“赢家通吃”效应显著,竞争无序后果堪忧。网约车市场资本无序扩张也为市场监管者、经营者招致如监管套利、数据采集侵犯隐私、算法歧视和大数据杀熟、平台数据垄断等质疑和指责,网约车市场规制体制亟须重塑。政策制定者应重新审视数字经济中的平台监管和竞争问题,现行法律低估定价和跨行业整合可能导致的反竞争风险这一问题已凸显出来。网约车市场规制应以反垄断法为抓手,强化算法透明度要求,加大竞争倡导和更新反垄断分析工具,以规范平台行为,促进市场依法规范发展,更好地发挥政府的作用。

Abstract: By virtue of the advantages of data, technology and capital, the platform field represented by the online car-hailing market is showing a trend of increasing market concentration and accelerating the concentration of market resources to the top platforms. The“winner takes all”effect is quite significant, and the consequence of the unordered competition is worrying. The disorderly expansion of capital in the online car-hailing market has also incurred questions and accusations on market regulators and operators, such as regulatory arbitrage, data collection infringement of privacy, algorithm discrimination and using big data to cheat the acquaintances, platform data monopoly, etc. The regulatory system of the online car-hailing market is in urgent need for reshaping. The policy makers should re-examine the platform supervision and competition issues in the digital economy. The possible anti-competitive risks probably resulted from the underestimated pricing of the current laws and the cross-industry integration have become prominent. The regulation of the online car-hailing market should take the anti-monopoly law as a starting point, strengthening the requirements for algorithm transparency, increasing competition advocacy and updating anti-monopoly analyzing tools, standardizing platform behaviors, promoting the development of the market in accordance with the law, and giving a better play to the role of the government.
