摘要: 社会救助立法是当代重要的社会立法。民国时期的社会救济立法日益完善,象征着中国社会救助制度由传统向近代法治化转型的萌芽。滥觞于民国时期的社会救济立法,在变革法治规则理念实现救助常规化、突破恩赐思想强调政府责任、创新救助方式发挥造血机能以及倡导规范化的救助管理等方面都做出了有意义的探索,对战乱时期民众权益的保障、社会矛盾的缓解、国家一致对外形势的维护都发挥了重要作用,对转型期中国社会救助立法的建构和完善具有重要的借鉴价值。当前社会救助法制化及其制度构建对此应当予以认真对待。

Abstract: The social assistance legislation is an important social legislation in the contemporary era. During the period of the Republic of China, the social relief legislation was increasingly perfected, symbolizing the burgeoning of China’s social relief system transiting from the traditional one into the modern legal one. The social relief legislation that started from the period of the Republic of China made some meaningful explorations in such areas as changing the legal rules and ideas to normalize the rescue routine, breaking the gifted thinking to emphasize the government responsibilities, innovating the rescue methods to give full play to the hematopoietic function, and advocating the standardized rescue management, which played an important role in the protection of the rights and interests of the people in the times of war, the mitigation of social conflicts, and the maintenance of the national unanimous attitude towards the outside situation. All of these can offer some valuable reference to the construction and perfection of China’s social assistance legislation during the transitional period. The current social assistance legalization and the system construction should pay serious attention to them.
